It seems that it works a bit differently on PS3. If a squad gets split up (which does still happen after the patch), it will allow you to switch teams even if the teams have equal numbers, but not if the team you are trying to switch from has fewer players than the team you are trying to switch to.
Even when it does split up our squad of four, we can always get back together within a round or 2, tops. And once you get in the same squad in a game, you'll stay there no matter what.
I imagine that if it's not like this on 360, it will be once you get the patch.
