What wouldn't be legal about it? If they make the firmare on the machine unusable because somebody modded the hardware what possible legal recourse would you have? You broke the TOS.


They can't read or change the firmware on the dvd drive at all, therefore just breaking the console because they've detected you are being naughty is entirely different from say putting in new copyright protection that just so happens to make an existing hack bork a console over (ala the current Wii situation). Otherwise it's sabotage.

they couldn't break the console itself - there are no terms of service with a 3rd party for something that you own, but they could break the ability for that console to work on facilities that they do provide. Apple do this all the time

The new holiday bundle (Pure/Batman) 360 as welll as most of the latest manufacturered ones are coming with a new LiteOn drive with a new 83850c / 93450c firmware that as of yet, nobody has been able to extract the key from - thus, is currently unflashable.

Returns nothing but 0000's.

Not much. We still don't know how they are detecting modified consoles, be it through detecting the modified firmware itself, purposely leaked and flagged ISOs, the way the drive reads copies or indeed the way the drive reads retail discs.

Nobody at this stage has a clue.

Even if its legal to make a backup, which I don't think it is anymore, it is definitely illegal to circumvent copy protection in order to use it.

MS not fucking around this time:

the iXtreme guy, c4eva, apparently announced to xxxx earlier that the haxed firmware is indeed detectable. he was running tests on 3 different setups these last couple of days and they were all banned at the same time.

I've said it before and I'll say it again. This ban wave came in effect due to the recent deployment of the Wave 4 security layer on some newer games. I dont want to go into explaining how this differs from Wave 3, or what the Wave security layers do. But in the end, MS found a way to detect modded consoles but had to get it out there through new games installing Wave 4.

People downloaded games like they always do, ran abgx360 and popped them in. Little did they know MS one up'd them. People assumed they were always going to be safe if they followed a few rules, but MS outsmarted them. Since Wave 4's introduction a new iXtreme 1.61 firmware has been released to allow consoles to play newer Wave 4 enabled games. However, last I checked 1.61 only works on Samsung optical drives.

I'll never quite understand pirates. The money they spend on getting their machines chipped, new consoles if they get banned, and the games (most pirates I've known have bought their copies from 'friends') all adds up. Why they couldn't just wait and get originals cheaply and sidestep all those pains in the arse I don't know.... but I suppose for a lot of them it's the principle of it all. :/

For most of them (at least the ones I know, some of them with even a better salary than mine) piracy is a hobby in itself, not video-games.

I make so much fun of them, I mock them saying "soon enough you'll be pulling electricity out of your neighbour, no?".

Anyway, it´s about a bunch of idiots who got their xbox´s banned and decided to make death threat calls to Stephen Toulouse´s (director of Xbox Live's policy enforcement) house, threatening his family and his dogs.

So is c4eva infact saying that it is Wave4 games that are ringing alarm bells, or just any firmware pre 1.61 itself? Confusing as he said all three of his test 360s were banned but one of them was a fresh 360 running 1.61, connected to live but not a single game played.

That'd be fair enough, that segregation would be good enough, imo. Anyway, judging by the death threats and shady foruns activity this "wave 4 ban" was realy nasty.

Illegal as mentioned earlier. One thing they have done is disable the ability to install games onto any hard drive attatched to that console.

While we're at it lets brick your niece's PC for illegally downloading ringtones too.
