    I was trying to get my brother to pick a copy up from the Argos in Swansea, but he wasn't able to get there today; went to reserve it again, via the Argos app as I was out visiting family, it automatically does a local search by default and a copy had shown up in one of the Gloucester stores, so that's now reserved for pickup tomorrow instead. Haven't checked on the Swansea store, again, so if someone's lucky they might find a copy there.

    In the meantime, now trying to catch one of the Wii U Party copies somewhere.

    So I went to pick up my Wii U Party for 14.99 yesterday. They sent down the Wii version so I asked them to get the Wii U version. They then said that the code was correct and that was probably sent by the main warehouse in error so I walked away empty handed :-(

    Hey, I played Skyward Sword the whole way through, on my Wii U, it just depends on how long a game it is as to whether I finish it or not.

    Xenoblade is a 100+ hour game. You could rush through it, but you'd get so much more out of it if you didn't. An absolute master piece. Sell everything else you own, so not to get distracted. :)

    Have a look on Ebay, greedy greedy cunts, I have no issue with someone making a few quid on it,but the pricks wanting 60,70 and even more money can do one. A couple of week back there were only 10 odd copies on there albeit all around the 35/40 mark. It is defo a rare game and once theses copies all go it will once again be so.

    I have the game and white pro controller, I will put it up for sell/swaps (I'm thinking 40 delivered for both, which I hope is not seen as too greedy or a currant game swap) in the coming weeks, so keep a look out.

    @AceGrace Same happened to me but I complained, showed them the email and told them they had 2 in stock and they honoured the price. Think it was just to get rid of me, but worth causing a fuss!

    I'm not sure what the situation is, legally, with this thanks to the way Argos is set up. I know that if you go to buy an item and you've paid for it, the seller cannot demand you then pay more for it due to a mistake, afterwards; the crucial point, normally, is that you usually have the item in your possession at that point if a mistake is realised.

    Because you're essentially buying the item "blind", you have to trust that the description of it matches the item you're going to receive; I'm presuming that if you go to the checkout desk and they state to you "204/6464, Wii U Black Remote Control and Wii U Party Game at 14.99" which you then pay for, they're obliged to supply exactly that as they've already taken your money and agreed the contract with you.

    Anyone with a greater legal knowledge know the exact situation here?

    I'd imagine it would fall under something like the distance selling regulations? It's certainly more akin to buying off Amazon than in-store, for instance. Only difference is you pick it up rather than it comes to you.

    I don't think they would be under any legal obligation to give you the item they advertised for the advertised price. If they've mistakenly mis-priced something, they'd be able to just refund you and take the wrong item back. Although it's been a while since I looked at this stuff!

    @CosmicFuzz I wouldn't have thought so, with distance selling the contract doesn't apply until the goods have shipped, you then also get a 7 day cooling off period; this is only a reservation, with the purchase being made at the till, you're having to accept a description and verbal confirmation before confirming the transaction and completing the contract. If they then try to hand over something different, that would, potentially, be classed as deception on their part.

    But are you paying for the goods online, or in store?

    If you're paying for the stuff instore, and only reserving it online, then they're definitely within their ambit to refuse to honour the misprint. When you go up to try and pay, no contract has been entered into yet, it's simply an invitation to treat. You're asking the shop if they want to enter into the contract with you, but they can always say no.

    @CosmicFuzz Missing the point, with Argos you pay at a checkout and then pick up the item from another counter: if they then bring out a different item to what was described, and which is usually verbally confirmed at the checkout as well, then they can no longer claim it's a mis-pricing issue as far as I can tell. I believe that taking the payment is the conclusion of the contract, not the receipt of the goods, unless someone can point me to any text which confirms it's the latter.

    It doesn't matter if you pay at one counter and pick up from another I wouldn't have thought. The contract is concluded when both parties have fulfilled their obligations - the shopper pays and the store hands over the goods. Until that happens, it's not concluded. Doesn't matter if you pay first or receive the goods first.

    So when you pay at the first desk, until you receive your item, the contract isn't finished. If there's been a mistake and they try to give you the wrong item, they're not in breach of contract or anything like that.
