It could be a civil case. And if top secret documents are easily accessible by any GIJOE then they are not secret no more.

How exactly could it be argued that revealing these docs is essential to the defence. And civil case?Not the defense but the prosecution. You can't arrest someone for receiving a usb stick and not doing anything with it.
